November 16 to 30, 2009

R. v. C.P (Toronto: North York, 1000 Finch Ave.).  Charges: Fraud Over $5000.00.  Allegations: Employee alleged to have embezzled a significant amount of money from employer (over $50,000) through her signing authority.  Result: All charges withdrawn.

R. v. A.W-L. (Oshawa, Youth Court): Charges: Assault With a Weapon, Threatening Death, Unlawful Entry, etc.. Allegations: Youth alleged to have attended girlfriend’s home while another boy is over.  Accused was alleged to have lost temper, pulled out a weapon and threatened her with it.  Result: Youth is to return in several months after completion of anger management to have charges withdrawn.

R. v. J.W.: (Superior Court of Justice, Kitchener) Charges: 1) Possession of a Loaded Restricted Firearm, 2) Possession of a Weapon (firearm) for a purpose dangerous to the public peace, 3) Transporting Firearm in a Careless Manner, 4) Possession of a Restricted Firearm not while not the holder of a licence to do so, 5) Occupant of a motor vehicle knowing that there was a restricted firearm within, 6) Possession of a Firearm, 7) Knowingly possessing a firearm while knowing that he was not authorized to do so, 8) Possession of marijuana for the purpose of trafficking, 9) Proceeds of crime (apx. $5000.00), 10) Possession of a firearm with the serial defaced, and 11( Impaired Operation of Motor Vehicle.  Allegations: Accused stopped at R.I.D.E. program around the holiday season as a lone occupant.  Accused arrested as a result of impaired driving.  Upon search of the vehicle, police discover a loaded firearm in the glove box, marijuana with baggies and scale, and a large amount of money in cash.  Result: Matter brought through a preliminary inquiry and then a jury trial.  Accused ultimately found guilty of only one offence of “careless transport of a firearm” and sentenced to 6 months house arrest with exception to work and emergencies, then 6 months of curfew. All other (10) charges dismissed.

R. v. N.N. (Newmarket) Charges: Theft Under. Allegations: Shoplifting Prada shoes from a designer outlet.  Result: Charges withdrawn.

R. v. A.A. (Milton): Charges: Theft Under.  Allegations: Shoplifting.  Result: Charges withdrawn.

R. v. B.L. (Brampton) Charges: Assault Causing Bodily Harm, Assault with a Weapon, etc. Allegations: Accused alleged to have caused massive head injuries to complainant in the course of a bar brawl with a pool cue or ball.  Result: All charges withdrawn.

Weeks of November 2 to 13


R. v. S.A.: (Toronto, College Park) Charges: Theft Under.  Allegations:  Accused said to have stolen packs of underwear at a major retailer.  Result: All charges withdrawn.
R. v. G.C.: (Toronto, College Park) Charges: Assault, Threats.  Allegations: Confrontation between employer and employee over wages being owed.  Allegations of assault by the employer on the employee.  Police are called and owner of business arrested.  Result: All charges withdrawn
R. v. S.U. (Toronto, College Park) Charges: Assault (Domestic).  Allegations:  Accused said to have tossed a plate of food on the complainant after a heated argument in the presence of the accused’s mother.  Result:  All charges withdrawn.

October 19 to 30, 2009

* Entire two weeks devoted to sexual assault, kidnapping, human trafficking jury trial with two other co-accused.  


R. v. A.R. et. al. (Peel Region, Brampton Courthouse) - JURY TRIAL
Charges: Sexual Assault, Aggravated Sexual Assault, Gang Sexual Assault, Kidnapping, Forcible Confinement, Human Trafficking, Sexual Assault with a Weapon, etc. 
Allegations: Woman is assaulted, intimidated, and kidnapped in lieu of a debt owed by her boyfriend.  When she is taken back to to a residence is Mississauga, she is sexually assaulted, tortured, confined in a closet overnight, and sexually assaulted the following day with forced fellatio and intercourse.  During the course of the sexual assault, she is threatened to be forced into prostitution.  Woman is released form the premises and attends hospital with injuries.  Hospital then reports the incident to police who the obtain evidence that included, but not limited to: DNA, photographs, corroborating physical evidence (shoelaces, descriptions of residence, etc.).  Canada wide warrants are executed and four individuals arrested including "A.R." During the course of the proceedings, it was alleged that Mr. A.R. (represented by Sean Robichaud) is alleged to have been present during the entire first day/night but not to have engaged in any of the threats, sexual assaults, or kidnapping but charged and ordered to stand trial regardless.  
Result: A.R. is found NOT GUILTY on all counts and dismissed unconditionally at trial.  The remaining accused parties are found guilty on al counts with the exception of two.

Week of October 5, 2009

Monday: Bail hearing in London, Ontario where accused alleged to have inappropriate sexual relationship with person in position of trust.  Result: Client released.
Tuesday: Brighton, Ontario: R. v. S.H.  Client pleads to a domestic assault allegation after detained at his bail hearing.  Client released on time already served so that he could attend his father's funeral the following day.
Remainder of week: continue work and preparation for upcoming homicide trial in the New Year and jury trial starting next week for sexual assault allegations.

Week of September 27, 2009

R. v. C. (South West Ontario): Charges: Possession of Loaded Restricted Firearm x 2, Careless Storage of Ammunition, Possession of a Controlled Substance for the Purpose of Trafficking, Production of Marijuana, Possession of a Prohibited Weapon, Possession of Proceeds of Crime, etc. Allegations: Major police undercover project on various figures throughout the GTA allegedly uncovers conspiracies to import drugs into Canada vis a vis Mexican nationals. Warrants are executed throughout the golden horseshoe.  Upon search of AC's residence, police allegedly discover firearms, cocaine, MDMA, a grow operation in the basement, weapons, a large amount of currency, etc. Result: After many months of being before courts and various proceedings and constitutional motions, the prosecutor agrees to accept a guilty plea to the drug related offences of cultivation and possession of a controlled substance for the purpose of trafficking and proceeds.  Firearms and other offences withdrawn.  Client receives an 8 month conditional sentence: 4 months house arrest with exceptions for work and school, the remaining 4 months to be served under a curfew.  All remaining counts against him and two family members were withdrawn.
R. v. R.D (Owen Sound): Charges: Possession of Marijuana.  Allegations: Friends attend up north for camping trip and polcie discover substantial amount of marijuana in the vehicle and on their person.  Result:  Charges withdrawn upon completion of community service hours.
R. v. O & N: Charges: Theft Under (Toronto Old City Hall).  Allegations: Shoplifting.  Result: Charges withdrawn.
R. v. J.D.: Charges: Theft (Toronto Old City Hall).  Allegations: Theft from an retail chain employer.  Result: Charges withdrawn.

Week of September 21

Monday: Judicial pre-trial held on a multiple accused robbery.  Adjourned for continuation in October.
Tuesday: R. v. S.K.  (Newmarket) Charges: Fraud x 3, Possession of Fraudulently Credit Card, Possession of Property obtained by Crime x 3.  etc.  Allegations of using multiple fraudulent credit cards at a large department store to buy merchandise including laptop computers.   Accused was apprehended by security at the scene and provides full inculpatory statement.  Result: S.K. pleads to one count of fraud and receives a conditional discharge.
Wednesday: 1) Judicial Pre-trial on sexual assault allegations.  Matter to return for continuation in November once Crown has assessed their case for reasonable prospect of conviction.
2) R. v. TP (Toronto) Charges: Possession of Cocaine.  Allegations: Possessing cocaine while at Toronto's entertainment district partying.  Result:  Charges withdrawn.
Thursday: At 361 University Superior Court doing adminstrative matters and then in the office meeting with clients and working on an upcoming homicide case.
Friday: R. v. J.S. (Toronto - Old City Hall) Charges: Domestic Assault.  Allegations: Woman alleged to have threatened partner with knife after it was believed he was cheating on her.  Result:  Charges withdrawn.  Client enters into section 810 peace bond.   

Week of September 14, 2009

R. v. J.W. Commencement of jury trial in Kitchener. Monday jury was selected.  Case adjourned later in the week until November.

Week of September 7, 2009

Week of preparation for upcoming jury trials and motions.
Monday: Labour day.  Case prep.
Tuesday and Thursday: Meetings on upcoming homicide case in Barrie.
Wednesday: Judicial pre-trial on the Oakwood TTC shooting case.
Friday: R. v. A.W.  (Ottawa).  Fly in to Ottawa to attend for trial. Charges of domestic assault and mischief charges to be withdrawn on next court date.

Week of August 30

Monday: R. v. A.I. (Toronto College Park): Domestic assault and threatening charges against former spouse.  Motion filed for unconsituional delay in proceedings.  Trial date abandoned by Crown and all charges withdrawn.
Tuesday: R. v. L.R. (Toronto 1000 Finch Ave W.) Allegations of domestic assault, assault with a weapon, possession of weapon for a purpose dangerous tot he public peace, and threatening charges against spouse where accused is said to have threatened complainant with knife.  Contested trial commenced. Result: Acquitted (not guilty) on all charges.
Wednesday: R. v. M.M. (Toronto Old City Hall): Charges of mischief under x 4, possession of stolen property, and property obtained by crime.  Allegations of student in wild frenzy while intoxicated and causing significant damage to property.  Result: All charges withdrawn (6 charges total).
Thursday: R. v. J.E. (Brampton): Allegations of a landlord/tenant dispute that resulted in charges of mischief, theft, and possession of stolen property.  Tenant alleged to have attended landlord's place of business and stole a television off the wall in retaliation for money owed.  Result:  All charges withdrawn.
Friday: R. v. A.G. (Scarborough).  Domestic assault allegations laid as a private complaint.  Complainant counter charged A.G. after she called police and laying multiple charges.  Result: All Charges withdrawn

Week of August 30, 2009

Week of: Preparation week for upcoming jury trials.
Thursday: R. v. AB (Newmarket): Domestic assault allegations against daughter. Charged with assault with a weapon and assault causing bodily harm. Client pleads to sole count of assault (included offence) and receives and absolute discharge.

Week of August 17/09

Monday: R. v. AA: Possession of Cocaine charges withdrawn (Toronto, Old City Hall)
Tuesday: Interview with Lawyer's Weekly
Wednesday: R. v. A.A.: Theft Under charges withdrawn (Milton, Ontario)
Thursday: R. v. JD: Theft Under (breach of trust) charges withdrawn; R. v. O.A.: Continuing sexual assault preliminary hearing.
Friday: R. v. LM: Domestic Assault charges withdrawn (Milton, Ontario)

August 11 to 13

R v O.R. Charges: Fail to remain at the scene of an accident, take
auto without consent, drive without licence. Result: All criminal
charges withdrawn. Client pleads to highway traffic Offence for $500
fine. No criminal record.

R v DP. Charges: Possession of Marijuana x 3, fail to attend court,
obstruct police, assault police, etc. Result: Charges to be withdrawn
upon completion of Counselling.

R v AA. Charges: possession of cocaine. Result: charges to be
withdrawn on next court date.

August 10, 2009

R. v SB. (Oshawa Courthouse)Charges: criminal harassment, mischief
under $5000.00. Alleged to have set up escort ads on craigslist for
another person and made threats to her safety. Result: All charges
withdrawn upon client entering into a section 810 peacebond.

R v AM. (Toronto Old City Hall Courthouse). Charges: Possession of
marijuana. Result: Charges withdrawn.

Week of August 3

R. v. S.D. Charges: Possession of cocaine for the purpose of trafficking. Alleged to have been acting suspiciously in a motel in Peel Region. Police investigate and allegedly find 3.5 grams of cocaine. Result: Charges to be withdrawn upon completion of 35 hours of community service.

R. v. C.D. Charges: Sexual assault allegations upon his daughter. Matter scheduled for a preliminary inquiry in April of 2010.

Week of July 20, 2009

Monday: Speed racing case in London Ontario adjourned for trial. Tuesday: Appear in Newmarket court for a judicial pre-trial on a domestic assault allegation.  Wednesday: Published in the Criminal Lawyer’s Association “From the Defence” newsletters for an article on bail and bail principals.  Thursday: multiple meetings with clients in the office to discuss case strategies and positive developments.

July 15, 2009

Old City Hall: Charges of possession of marijuana to be withdrawn on return date after client completes community service hours.

North York (1000 Finch): Judicial pre-trial completed on the "TTC Oakwood Shooting". Preliminary hearing tentatively scheduled for March, 2010.

July 13, 2009

Old City Hall: Allegations that accused was intoxicated in entertainment district in Toronto and with friend who was drinking in public. Upon investigation, the accused was alleged to have been in possession of cocaine. Trial date scheduled for today's date. Charter application filed alleging abuse of constitutional rights. Result: Charges to be withdrawn on next date after completion of some community service hours.

July 10, 2009

Old City Hall, 111 Court: Woman charged with assault x 4 after an altercation with security at a concert. Allegations that one security guard was injured and the remaining were all assaulted during the course of trying to remove her from the premises. RESULT: Charges withdrawn.

Old City Hall, 112 Court: Charges of Possession of Marijuana for the Purpose of Trafficking, Escape Lawful Custody, Possession of Proceeds of Crime, Possession of Marijuana Under 30g. RESULT: Client pleads to one count of simple possession of marijuana and granted an Absolute Discharge. All remaining charges withdrawn.

July 9, 2009

Women alleged to have stolen over $500 worth of clothing and merchandise from Winners. Charges of theft under $5000.00 withdrawn at 2201 Finch Avenue courthouse today.

July 8, 2009

R. v. N. Husband and wife alleged to be involved in a shoplifting that resulted in a struggle with security guards. Charges withdrawn today at College Park courthouse.

July 7, 2009

R. v. D.T. (Milton): In a highly intoxicated state, client was alleged to have broken into several cars with friend and stealing ipods, money, and various valuable items. Client and co-accused caught in the act by police with property in their possession. Both individuals provided incriminating statements to police. Result: Client pleads guilty and received a conditional discharge in light of his proven community involvement, school marks, good character, and overall circumstances of case.
